Pursuant to the provisions of Law 34/2002 of 11 July on Information Society Services and Electronic Commerce (LSSI), this legal notice regulates the use of the TheNetwork.es website service and informs Internet users that this website is owned by Marta Montserrat Ventura Torras with address at Vía Països Catalans 34 - 40 bajos, 43700 El Vendrell.

Terms of use
Access to and use of the website www.thenetwork.es (hereinafter, the Website) grants the status of User to the visitor of the Website and implies the User's full and unreserved acceptance of these conditions of use. In the event of non-acceptance, please do not use the Website.
Intellectual and industrial property
The Website and its contents, including designs, texts, graphics, logos, icons, buttons, as well as software, trade names, trademarks, works, illustrations, photographs or industrial drawings and any other signs susceptible to industrial and commercial use (i) are the property and ownership of The Network or of third parties who have duly authorized their inclusion on the Website and (ii) are protected by national and international legislation on intellectual and industrial property.
In no case shall The Network be deemed to grant any license or waive, transfer, assign, in whole or in part, said rights, nor confer any right or expectation of right, and in particular, of alteration, transformation, exploitation, reproduction, distribution or public communication on said contents without the prior express written authorization of The Network or the corresponding owners.
The User may only use the Website and its contents for personal and private use. Any other use is prohibited and requires the User to obtain prior express written authorization from The Network.
User Obligations
In general, Users must always act in accordance with the law, good customs and the requirements of good faith, using due diligence and refraining from using the Website in any way that may impede, damage or deteriorate the normal operation of the Website, the assets or rights of The Network, its suppliers, other users or, in general, any third party.
Specifically, and without implying any restriction to the previous section, during the use of the Web, the User is obliged to:
a) Provide truthful information about the data requested in the registration or order form, and keep them updated.
b) Not to introduce, store or distribute on or from the Web, any information or material that is defamatory, insulting, obscene, threatening, xenophobic, incites violence, discrimination based on race, sex, ideology, religion or that in any way violates morality, public order, fundamental rights, public freedoms, honor, privacy or the image of third parties and, in general, current regulations.
c) Not to introduce, store or distribute through the Web any program, data, virus, code, or any other electronic or physical device that may cause damage to the Web, any of the services, or any of the equipment, systems or networks of The Network, any other user, The Network's suppliers or in general any third party.
d) Not to carry out advertising or commercial exploitation activities through the Web, and not to use the contents and information therein to send advertising, or messages for any other commercial purpose, or to collect or store personal data of third parties.
e) Not to use false identities or impersonate others when using the Website or any of its services, including the use, where applicable, of passwords or access keys of third parties or in any other way.
f) Not to destroy, alter, use for your own use, render useless or damage the data, information, programs or electronic documents of The Network, our suppliers or third parties.
g) Not to introduce, store or distribute through the Web any content that infringes the intellectual or industrial property rights or trade secrets of third parties, or in general any content of which you do not have, pursuant to law, the right to make available to third parties.
Confidentiality.
By virtue of this legal notice, the user/client/service provider agrees not to disclose or reveal data, technical specifications, secrets, methods or systems, and in general, any mechanism related to the information to which they will have access and which is revealed by the other party, consequently they agree to maintain absolute confidentiality of the information they handle during the term of the professional relationship and for up to six months after it has ended. In case of doubt as to whether certain information is considered a trade secret, it must be treated as confidential.
The parties expressly agree to use all measures that are necessary and convenient to ensure that their personnel comply with and observe said confidentiality by refraining from disclosing or reproducing, in whole or in part, the information they obtain or produce in connection with the provision of services contained in this contract.
The data, information and results that are revealed to which both parties have access are the property of each of them, being subject to the provisions of said legal order, so they may not be disclosed without the express written authorization of the counterparty, accepting from this moment that the violation or non-compliance with the provisions of this clause may be included within the assumptions contemplated within the infractions included in the applicable regulations.
It is expressly stated that information that is in the public domain on the date it is published will not be considered confidential information. Both parties also agree that the information contained in the database catalogues is considered public domain and will not be considered, for the purposes of this contract, as confidential information.
Cancellations.
To cancel the renewal of the service, you must contact us in writing by email at hola@thenetwork.es at least 7 days before the renewal date.
It is the client's obligation to notify in a timely manner any non-renewal or cancellation of any of the contracted services.
Returns.
For the correct monthly planning of services, The Network's refund policy consists of deducting from another contracted service the prorated and unfulfilled portion of the service you wish to cancel.
In cases where the client does not have any other contracted service, a credit will be generated in his/her favor, which will be discounted in the future contracting of a new service.
Responsibility The Network
The Network acts solely as a manager between its clients and the platforms or channels on which it provides the service (Google, Facebook, Instagram, Twitter, etc.), and therefore will not assume any liability in the event that a client's account may be cancelled, paused or retained, and the appropriate claim must be addressed to the platform, which, by prior acceptance of the Terms and Conditions at the time of account creation, makes the client or user responsible for any type of liability that may arise as a result of violating its terms and conditions.
The Network Promotion
By becoming a client of The Network, the client gives his consent for The Network to freely advertise his brand on its website or in any other promotional medium. In this same way, the client can request to remove said advertising, or not authorize the use of his brand by writing an email to hola@thenetwork.es

Applicable legislation and competent jurisdiction
The conditions of use of the Website are subject to Spanish law and any disputes arising therefrom shall be resolved before the Courts and Tribunals of the city of Madrid, Spain, which shall have exclusive and excluding jurisdiction over any other jurisdiction. This shall be without prejudice to the jurisdiction of the Courts and Tribunals of the consumer's domicile in the event that the User has the status of consumer and user as provided for in Law 1/2007, which approves the revised text of the General Law for the Defense of Consumers and Users, as well as other complementary laws or current regulations that replace it at any time.
